2. Acceptance of the terms
By accessing and using the platform, any visitor, partner or user confirms that they have read, understood and accept these Terms and Conditions. If you do not agree with these conditions, please stop using the platform.
The operator reserves the right to update these terms periodically. The applicable version is the one published on the platform on the date of access. For partners, substantial changes will be communicated accordingly.
3. Purpose of the platform
Green Vision Planet is a platform dedicated to sustainability in tourism, which provides:
- sustainability assessment and certification for tourism partners (hotels, guesthouses, restaurants and other operators), including the calculation of a sustainability score and the issuance of certificates and badges;
- a voluntary sustainability contribution system, through which the partners' customers may add, at the time of a transaction, a voluntary contribution intended to support sustainability initiatives;
- the organization of promotional raffles in which contributors take part, under the conditions of a separately published set of rules;
- integration tools (widget, API keys) made available to partners for implementation on their own websites.
The presentational information published on the platform is for informational purposes and does not, in itself, constitute a firm contractual offer in the absence of an express confirmation from the operator. Contractual relationships with partners are established separately, through contracts, offers and specific documents.
4. Partner accounts
4.1. Creating an account
Partners can benefit from the platform's services by creating an account. The partner is responsible for the accuracy and timeliness of the data provided (company identification details, tax data, contact details, bank details).
4.2. Account security
The partner is responsible for keeping the authentication credentials and the API keys associated with the account confidential. Any activity carried out through the partner's account is the partner's responsibility. The partner must notify the operator in case of unauthorized use.
4.3. Use of API keys and the widget
The API keys and widget code provided by the platform are intended exclusively for integration on the partner's authorized domains. It is forbidden to transmit the keys to unauthorized third parties or to use them for any purpose other than the one agreed upon.
4.4. Account suspension
The operator may restrict or suspend access to the account in the event of suspected misuse, fraud, breach of these conditions or of contractual obligations.
5. Sustainability contributions
5.1. Nature of the contribution
The sustainability contribution is voluntary and is chosen by the customer at the time of the transaction. The contribution can be added in two ways:
- (a) online – within a transaction carried out on the partner's website, through the partner's payment methods;
- (b) at the partner's point of sale (for example, at the reception desk or the checkout), when the purchase is not made online. In this case, payment is made in cash or by another payment method accepted by the partner, with the issuance of a fiscal receipt or an invoice, and the customer registers the contribution by scanning the QR code on the partner's eco badge and entering the receipt/invoice number.
The applicable percentage is displayed at the time of the transaction.
5.2. Payment processing
Payment of the transaction and of the associated contribution is made at the partner (on their own website or at their point of sale), through the partner's payment methods. Green Vision Planet does not process payments and does not collect bank card data from contributing customers. The platform only records the fact that a contribution has been added, for the purpose of confirmation, participation in the raffle (where applicable) and reconciliation with the partner.
5.3. Use of the contribution
The contribution is intended to support sustainability initiatives. The amounts collected from contributions are used, in general terms, for:
- (a) supporting sustainability at the partner level;
- (b) the operation, development and maintenance of the platform;
- (c) marketing and promotion services – a part of the amounts is used for marketing services and for promoting the platform, the partners and the sustainability initiatives;
- (d) transferring a part to a partner NGO, for the purpose of planting trees and supporting environmental projects.
Details regarding the concrete way the amounts are used and distributed are presented by the operator and/or the partner.
6. Promotional raffle
Participation in the promotional raffle takes place under the conditions of a Raffle Rules document published separately on the platform. The Rules establish the eligibility conditions, the participation mechanism, the prizes, the drawing and claiming procedure, as well as other applicable conditions, including any country restrictions.
In the event of any discrepancy between these Terms and the Raffle Rules regarding matters related to the raffle, the provisions of the Raffle Rules shall prevail.
7. Sustainability certificates and badges
The certificates, badges and sustainability scores issued through the platform reflect the data provided and the assessment carried out according to the platform's methodology. They can be publicly verified through the verification tool available on the platform.
The partner may use the certificates and badges received only correctly and without being misleading, exclusively in connection with the property/period for which they were issued. Misuse, alteration or misleading display thereof is prohibited and may lead to the withdrawal of the certification.
8. Rules of use
Users undertake to use the platform lawfully, in good faith and without carrying out actions that may affect its operation, security or integrity.
The following are prohibited:
- transmitting false, illegal, defamatory, abusive or malicious information;
- introducing code or carrying out actions that may affect the platform's technical infrastructure (cyberattacks, unauthorized access attempts, overloading the systems);
- using the platform for fraud or for infringing the rights of third parties.
The operator may restrict or suspend access in the event of such breaches. The platform may be temporarily unavailable for maintenance, updates or technical reasons beyond the operator's control.
9. Intellectual property
The platform's content — including texts, names, the Green Vision Planet brand and logo, the structure, graphic elements, informational materials, the widget code and any other published elements — belongs to S.C. ASISARTAS S.R.L. and/or its partners, unless otherwise indicated, and is protected by copyright and intellectual property legislation.
Without the prior written consent of the rights holder, it is prohibited to copy, distribute, modify, republish, transmit or exploit the content for purposes other than those permitted by law or those necessary for the normal use of the services (for example, the integration of the widget by partners on authorized domains).
10. Limitation of liability
S.C. ASISARTAS S.R.L. makes reasonable efforts to ensure that the information published and the services offered are correct, up to date and functional, but does not guarantee the complete absence of errors, omissions or technical interruptions.
To the extent permitted by law, the operator is not liable for direct or indirect damages resulting from: the use or temporary inability to use the platform; the interpretation of information without further verification; the actions or payments made at partners (on their websites or at their points of sale); the content of external resources to which the platform may refer.
The platform may include references to external resources or third-party platforms, over which the operator has no control and for which it is not responsible.
11. Protection of personal data
The processing of personal data through the platform is governed by the Privacy Policy published separately on greenvisionplanet.com. Data subjects benefit from the rights provided by the GDPR (access, rectification, erasure, restriction, portability, objection, withdrawal of consent), which they may exercise in accordance with the Privacy Policy.
12. Cookies
The platform may use cookies and similar technologies for operation, security and preference management. Optional tools (for example, analytics tools such as Google Analytics) are activated only with the user's consent, expressed through the cookie banner, and are managed according to the options expressed by users and the Privacy/Cookie Policy published on the platform.
13. Applicable law, international use and dispute resolution
The Green Vision Planet platform is operated from Romania by S.C. ASISARTAS S.R.L., but it is also available and may be used at European and international level, by partners and users from different countries.
These Terms and Conditions are governed by Romanian law and, to the extent applicable, by European Union law. For users and partners from other states, the mandatory consumer protection and personal data protection rules in force in the user's country of habitual residence apply on a complementary basis, where they provide a level of protection that cannot be set aside by agreement of the parties.
Any dispute arising in connection with the use of the platform will be resolved, as a priority, amicably, by contacting the operator using the details indicated in the Contact section.
For consumers in the European Union, alternative dispute resolution (ADR) may be carried out through the consumer dispute resolution entities recognized in the member states, namely through the European Consumer Centres Network (ECC-Net). The list of consumer dispute resolution entities is available on the European Commission's website, in the section dedicated to consumer redress.
In the absence of an amicable settlement, disputes will be submitted to the competent courts according to the applicable law, without prejudice to consumers' right to bring proceedings before the competent courts in their country of residence, where the law grants them this right.
